Terms & conditions

The rules of using this site

What our tools do and don't promise, what happens when you ask us for warranty help, and the messaging terms for the text programme. Written to be read, not to be skipped.

Before anything else

1. Messaging terms (SMS programme)

Programme name: The Lemon Report Warranty Assistance.

Who operates it: thelemonreport.org is operated by Ocwen Inc.

What messages you will receive

If you submit the warranty assistance form on this site and tick the consent box, you are opting in to receive calls and text messages from The Lemon Report about extended vehicle service contract and warranty coverage for the vehicle you entered. Messages are conversational — we reply to your request, answer questions, and pass on coverage options. We do not add you to a recurring marketing list.

How people opt in

There is one way to join through this website: submitting the warranty assistance form and ticking the consent box, which records your agreement together with the exact wording shown to you.

We may also hold a number you gave us directly — by phone, by email, in person, or on a written or electronic form — while asking about coverage or while we were already assisting you. Those numbers receive service messages about the request you made. They receive marketing messages only where prior express written consent was given and recorded. We do not message numbers obtained from purchased lists, lead vendors, data appends or any third-party source.

Message frequency

Message frequency varies. You will receive messages in response to the assistance you requested, so the number depends on your conversation with us. There is no fixed schedule and no recurring campaign.

Message and data rates

Message and data rates may apply for any messages sent to you from us and to us from you. We charge nothing for this service; your mobile carrier's standard rates apply.

How to stop

You can cancel the SMS service at any time. Just text STOP to the number messaging you. After you send STOP we will send you a message to confirm you have been unsubscribed, and after that you will no longer receive messages from us. To rejoin, sign up again as you did the first time.

How to get help

If you are experiencing problems with the messaging programme, reply with the keyword HELP for more assistance, or you can get help directly at markc@serviceactivationcenter.com.

Carrier liability Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your mobile carrier and is outside our control.

Eligibility

You must be at least 18 years old and either the subscriber of the mobile number you give us or authorised by the subscriber to opt that number in. Do not submit a number that is not yours.

Consent is not a condition of purchase

Agreeing to receive messages is never required to use this site, its tools, or to buy anything. Every tool here is free and fully usable without opting in.

Privacy

If you have any questions regarding privacy, please read our privacy policy: thelemonreport.org/privacy.html. In short: your mobile number is not shared with third parties or affiliates for marketing or promotional purposes, and your opt-in data is not shared with anyone.

2. The tools are estimates

The Vehicle Recall and Problem Finder, Vehicle Value Calculator, Vehicle Depreciation Calculator and Cost of Repairs Calculator are free informational tools. Every figure they produce is a modelled estimate built from public data and the details you type in.

You use these figures at your own discretion. We are not responsible for decisions made in reliance on them.

3. Warranty assistance

If you ask for help finding coverage, here is exactly what that means.

4. Not legal advice

The Lemon Report publishes journalism and general consumer information. It is not a law firm, no attorney-client relationship is created by using this site or contacting us, and nothing here is legal advice about your situation. Lemon law rights, deadlines and procedures vary by state and change often. Confirm anything you plan to act on with your state attorney general's office or a licensed attorney.

5. Acceptable use

Use the site for your own vehicle research. Do not:

6. Our content, and other people's

The written reporting, tool design, compiled databases, logo and name are ours. You may read, print and share links freely. You may not republish substantial portions commercially without permission.

Underlying government data — NHTSA recall and complaint records, EPA fuel economy figures — is public domain and belongs to no one. Videos are embedded from their original channels and remain the property of those creators. Links to other sites are offered for convenience; we do not control them and are not responsible for their content or their privacy practices.

7. Availability and changes

The site is provided as-is and as-available. We may change, suspend or withdraw any part of it, including any tool, at any time. We update these terms when what we do changes; the effective date below moves when we do. Continuing to use the site after a change means you accept the revised terms.

8. Where we operate, and whose law applies

Available in all 50 states

The tools, reporting and warranty assistance on this site are available to vehicle owners throughout the United States, in all fifty states and the District of Columbia. The messaging programme is available on all major US carriers.

Vehicle law is not uniform, and we do not pretend otherwise. Lemon law thresholds, deadlines, arbitration requirements and used-car coverage differ substantially from state to state — our reporting says so repeatedly, and the Resources page links each state's own authority. Nothing here overrides the law where you live.

Whose law governs

These terms, and any dispute arising from your use of this site, are governed by the laws of the state in which you reside, without regard to its conflict-of-laws rules. You may bring a claim in the courts of your own state.

Your state consumer rights are not waived Many states give consumers protections that cannot be signed away in terms of use. Nothing in this agreement waives, limits or displaces any right you have under the consumer protection, warranty, messaging or lemon laws of your state, or under federal law. Where any clause here conflicts with a mandatory protection in your state, that protection wins and the rest of these terms continue to apply.

9. Limitation of liability

To the fullest extent the law allows, The Lemon Report is not liable for any indirect, incidental, consequential or punitive damages, or for any loss arising from your use of — or inability to use — this site, its tools, or any estimate, figure or piece of information it produces. Nothing in these terms limits liability that cannot lawfully be limited, and nothing here affects your statutory rights as a consumer.
